Bundeskartellamt untersagt RTL und ProSiebenSat.1 Grundverschlüsselung

Bonn, 28. Dezember 2012: Das Bundeskartellamt hat Geldbußen in Höhe von insgesamt rund 55 Mio. Euro gegen die beiden TV-Sendergruppen Pro7Sat1 und RTL sowie gegen zwei verantwortliche Personen verhängt. Den Unternehmen wird vorgeworfen, bei der Einführung der Verschlüsselung ihrer digitalen FreeTV-Programme wettbewerbswidrige Absprachen getroffen zu haben. Außerdem verpflichten sich die beiden Sendergruppen, ihre wesentlichen Programme in SD-Qualität für einen Zeitraum von zehn Jahren unverschlüsselt anzubieten. Diese Zusage betrifft die Übertragungswege Kabel, Satellit und IPTV. Nicht davon umfasst ist die Verschlüsselung von HD-Programmen.
Andreas Mundt, Präsident des Bundeskartellamtes: „Das Bundeskartellamt hat festgestellt, dass sich die beiden Sendergruppen in den Jahren 2005/2006 darüber abgesprochen haben, ihre digitalen Free-TV-Programme in SD-Qualität zukünftig nur noch verschlüsselt auszustrahlen und dafür ein zusätzliches Entgelt zu verlangen. Zugleich beabsichtigten die Sendergruppen, durch technische Maßnahmen wie Anti-Werbeblocker und Kopierschutzfunktionen die Nutzungsmöglichkeiten der Programmsignale für den Fernsehzuschauer zu beschränken. Die Absprachen betrafen die Übertragungswege Kabel, Satellit und IPTV. Die Umsetzung dieser Absprachen erfolgte mindestens bis zum Zeitpunkt der Durchsuchung des Bundeskartellamtes bei den Unternehmen im Mai 2010, in etlichen Netzen über diesen Zeitpunkt hinaus.“
Die Bußgeldbescheide sind noch nicht rechtskräftig, über etwaige Einsprüche entscheidet das Oberlandesgericht Düsseldorf. Allerdings haben sich alle Unternehmen zu einer einvernehmlichen Verfahrensbeendigung (sog. Settlement) bereit erklärt.
Darüber hinaus hat das Bundeskartellamt von beiden Sendergruppen die verbindliche Zusage entgegengenommen, ab 2013 bundesweit auf die Grundverschlüsselung ihrer in SD-Qualität ausgestrahlten Free-TV-Programme zu verzichten. Die Sendergruppen werden die unverschlüsselte SD-Verbreitung für einen Zeitraum von mindestens zehn Jahren aufrechterhalten. Mit der Aufgabe der Verschlüsselung entfällt für die Sendergruppen die Grundlage für die Entgelterhebung gegenüber Kabelnetz- und anderen Übertragungswegebetreibern für die SD-Verbreitung. Zugleich entfällt die Grundlage für die Umsetzung von Signalschutzbeschränkungen.
Eine entsprechende Zusage zur Aufgabe der Grundverschlüsselung ab Januar 2013 hatte der Kabelnetzbetreiber Unitymedia bereits im Zuge der Freigabe der Fusion Liberty Global (Unitymedia)/Kabel Baden-Württemberg abgegeben (siehe Pressemitteilung des Bundeskartellamtes vom 15.12.2011 ).
Andreas Mundt: „Durch die Verpflichtung der privaten Sendergruppen zur Aufrechterhaltung der unverschlüsselten SD-Verbreitung steht den Fernsehzuschauern auch in den kommenden Jahren eine Empfangsmöglichkeit für digitales FreeTV offen, ohne Signalschutzbeschränkungen und ohne dass dafür zusätzliche Entgelte anfielen.“
